The complete process includes the I-140 petition processing (which can be expedited via Premium Processing, guaranteeing a USCIS response within 15 calendar days) and visa availability according to the Visa Bulletin, followed by an adjustment of status (for those already in the U.S.) or consular processing.
Yes. Your spouse and unmarried children under 21 can be included as dependents in the EB-2 NIW petition. They will receive the same lawful permanent resident status. Your spouse can apply for a work authorization (EAD) after submitting the adjustment of status, and your children can study in the U.S.
