Some important considerations when investing in the EB-5 Program

B-5 Program Green Card applications have become much more popular in recent years, after the US Citizenship and Immigration Services (USCIS) relaxed some requirements, along with an increase in the consistency of EB-5 Green Card approvals.

However, If you wish to enter the United States with your Green Card via investment, please note some timely considerations below.

Real Estate Projects

Real estate construction projects often require substantial investment, with abundant job creation that the EB-5 Program requires, and that investors can rely on. These projects can account for direct, indirect, and induced employment, as part of the construction budget. In that case, an economic study will determine how many total jobs will be created. Job creation is the key to the EB-5 Program, as each investor must create at least ten new jobs to qualify. Real Estate construction is ideal in this respect as it is labor-intensive.

By falling within a Targeted Employment Area (TEA), the vast majority of EB-5 projects in the past have qualified for the lowest amount of investment required: $500,000. The revised regulations have changed that. The regulatory revisions of November 21, 2019, substantially increased the stake necessary to be “EB-e compliant.”

To promote areas that are really in need of economic stimulus, the TEA rules are much stricter, and many projects will no longer qualify. Importantly, even TEA projects now require an investment of $ 900,000, while non-TEA investments must be at least 1.8 million to train.

Viable investment project locations are expanding

The new EB-5 market is changing. Currently, there are numerous projects, non-real estate, viable on the market, and many of them do not need to be built in a large city, unlike the needs of the large EB-5 real estate projects of the past.

It remains critical that an investor’s appetite for higher returns must always be balanced against the financial risk and immigration compliance: remember, an EB-5 Investment is, first and foremost, intended to result in a Green Card for the investor and his or her family.
